CERTIFICATE OF COMPLIANCE (for Qualified Employers)
All employers are required by law to file a secured Certificate of Compliance (COC) with the Commission. In conjunction with filing a compliance certificate, the employer is also mandated to obtain workers compensation insurance policy with an authorized carrier in the Territory. A COC is primarily designated for qualified employers who have been required by law to secure a workmen's compensation insurance coverage. Only by filing a secured a COC with the Commission as required under A.S.C.A. §32.0536, a qualified employer is confirmed to have successfully complied with all provisions of the ASWC Act.
Who are Required to File and Secure a COC:
The following employers are considered Qualified Employers and required to file a COC:

An employer regularly employing 3 or more employees.

An employer - regardless of employees employed - required or ordered by the Commissioner to obtain an insurance coverage due to the employer's industry, nature of business, or work type being highly prone to accidents to cause employee injuries or death. This may include businesses such as landscaping, diving, forestry, welding, auto mechanics, etc. - to name a few.

An exempted employer who voluntarily opts to secure its own workmen's compensation insurance.

Employers under self-insurance.
Documentations Required to File a COC:

Clearance form (WCC EC-1 FORM)

A copy of the carrier's coverage notice (or Notice of Workers Compensation Coverage Secured). Any time an insurance contract or policy coverage is secured, the carrier is required by law to provide the employer a coverage notice known as the Notice of Workers Compensation Coverage Secured as proof of a coverage being purchased. When filing a COC with the Commission, the employer is required to furnish and provide a copy of such notice.
