Failure to Make Compensation Payments on Time
Penalty - Failure to Make Payments without an Award
If any installment of compensation payable without an award is not paid within 14-days after it becomes due, there shall be added to such unpaid installment an amount equal to 10% thereof which shall be paid at the same time as such installment. This penalty is waived if the employer filed a notice of suspension payment based on valid reasons, or the Commissioner excused such payment after the employer is able to show conditions in which it has no control of causing such payment not to be made within the period prescribed.
Penalty - Failure to Make Payments with an Award
If the compensation payable under the terms of an award is not paid within 10-days after it becomes due, there shall be added to such unpaid compensation an amount equal to 20% thereof which shall be paid at the same time as such compensation, unless the review of the compensation order making such award is had and an interlocutory injunction allowed by the court to stay such payment.
