Workers Compensation Clearance
Clearance:
Any employer acquiring a business license to operate a business in the American Samoa is mandated by law to comply with all provisions of the American Samoa Workmen's Compensation Act (ASWCA). By obtaining clearance, the employer has proven to have secure a workmen's compensation insurance coverage with a local authorized insurance carrier; a compliance certificate (or an exemption coverage) successfully filed with the Workmen's Compensation Commission; and proof of satisfying the ASWCA with the Commission's Office.
Filing of Clearance with the Commission's Office:
To facilitate filing of workmen's compensation clearance, the employer is required to complete FORM EC-1 and submit it to the Commission's Office.
Documentations required to be submitted with the form may include:
For Qualified Employers:
(1) Copy of valid insurance policy
(2) Copy of Notice of Coverage Secured as issued by the carrier
For Exempted Employers:
(3) Copy of the expired or recently issued exemption certificate
Submission of the EC-1 Form Online:
Both the clearance form (EC-1) and all the supporting documentations as required by the form may be submitted via online if prefer. Please email both form and documentations to compliance@aswcc-gov.net.
