Medical evaluations & examinations

Medical Examinations:

Any medical examination required for workers compensation matters such as a permanent impairment evaluation, or an independent medical examination on employment capacity, shall be conducted by a qualified doctor authorized and designated by the Commission, or the Administrative Law Judge. Medical evaluations conducted and furnished by any certified or authorized medical doctor under the laws of the United States to conduct such examinations are considered qualified.

Any medical examination required by the Commission shall be the sole obligation and responsibility of the employee to ensure such evaluation is furnished and provided to the Commission. Furthermore, all qualified doctors approved or designated to conduct such examination are recommended to assist and help the injured employee on the requirement and scheduling an examination. Doctors must also ensure the evaluation are submitted by the deadline date and the proper forms as required for such examination during submission are being used. Failure to provide such a report may subject the examiner for obstruction of the claimant's hearing proceedings.

   

Scheduling & Submission:

It is the sole obligation of the employee to furnish and provide any workmen's compensation medical evaluation when required by the Commission. It is the employee's sole responsibility to seek and schedule such an examination with a qualified doctor authorized or designated by the Commission to conduct such examinations. Proceedings shall be suspended, and no compensation may be payable for any period during which the employee may refuse to submit to examination.

Authorized Forms Required during Submission:

 

When conducting either a medical reporting or a workmen's compensation examination, the treating physician or the qualified doctor must ensure the proper form authorized by the Commission to facilitate such requirement is used. The doctor is also required to attach and enclosed his full medical report with such form during submission. The following are some of the related forms prescribed and authorized by the Commission for workmen's compensation matters:

  • FORM MED-02: WC Evaluation for Permanent Evaluation

  • FORM MED-04: Independent Medical Examination - Employee's Ability to Resume Work or Employment
