OBLIGATION OF employee on medical billing

When do an employee fronts the medical bill?

The employee shall be solely responsible and obligated for the payment and coverage of his or her own medical billing or expenses on the following conditions. Under such circumstances, all medical billings must be provided directly to the employee.

  • The employer officially controverts right of compensation on employee claim;

  • The claim is rejected by the Commission under A.S.C.A. Sec. 32.0635;

  • The claim is rejected by the Administrative Law Judge or the High Court;

  • Employee voluntarily withdrawal claim before the Commission, the Administrative Law Judge, or the High Court;

  • Proven medical billing or expense not related to the work injury or filed claim; or

  • Failure of employee or medical provider to forward billing as claim on time
