Filing a Complaint against
a Minor Employer
A "minor employer" is an employer regularly employing 2 or fewer employees. These employers are exempted by law from workmen's compensation liability and do not require workmen's compensation insurance coverage. However, an employee can file an official complaint with the Commission against such an employer if its engaging in any occupational hazard affecting its employees.
To file an official complaint before the Commission, the employee must submit and file a Form RQ-9A: Notice of Employee Complaint on Occupational Hazard by a Minor Employer with the Commission's Office.
